These Terms of Use ("Terms") govern your access to and use of the Pic My Plate mobile application and website (together, the "Service"), operated by Pic My Plate ("we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Service for your personal, non-commercial use on a device that you own or control.
The Service lets you submit content, including photos of menus and dishes, comments, and profile information ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify, adapt, publish, and display it as needed to operate, improve, and promote the Service — including using dish photos to improve our food database and image-matching accuracy.
You represent that you have all rights necessary to submit your User Content and that it does not infringe the rights of any third party.
You agree not to:
We may remove content or suspend or terminate accounts that violate these Terms, at our discretion.
The Service may offer optional paid subscriptions that unlock premium features ("Subscriptions"). The following terms apply to Subscriptions purchased through the Apple App Store:
Subscriptions purchased through the Google Play Store are governed by equivalent terms provided by Google at the time of purchase.
Refund requests for purchases made through the Apple App Store or Google Play Store are handled by Apple or Google respectively, in accordance with their policies. We do not process refunds for store-based purchases directly.
The Service may rely on third-party services (for example, cloud hosting, image search APIs, or the app stores). We are not responsible for the availability, content, or practices of those third parties, and your use of them may be subject to their own terms.
The Service, including its software, design, logos, and content (other than User Content), is owned by Pic My Plate and protected by intellectual property laws. Nothing in these Terms transfers any such rights to you beyond the limited license above.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that menu scanning, dish matching, or other automated features will always be accurate.
To the maximum extent permitted by law, Pic My Plate and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service is limited to the amount you paid us, if any, in the 12 months before the event giving rise to the claim.
You may stop using the Service at any time and delete your account from within the app. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination will continue to apply.
If you downloaded the Service from the Apple App Store, the following additional terms apply. In the event of a conflict with the rest of these Terms, the terms in this section control for the App Store version of the Service.
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of the Service after the changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the jurisdiction in which Pic My Plate operates, without regard to its conflict-of-laws rules, except where mandatory consumer protection laws of your country of residence apply.
